Terms of Service

Please read these Terms carefully. By accepting these Terms and using our services, you agree to be legally bound by these Terms and all terms incorporated by reference. If you do not agree with these Terms or any clause, immediately cease using our services.

1. General Provisions

1.1 These Terms regulate relations pertaining to the use of the website https://lunaswap.example/ (the “Website”).

1.2 Terminology used in these Terms:

  • User / You / Your: the natural person accessing the Website, using our services and accepting these Terms.
  • LunaSwap / Ourselves / We / Us: the company operating the Website and providing the services.
  • Party: either you or LunaSwap. For avoidance of doubt, the contracting Parties under these Terms are you and LunaSwap.
  • Digital Asset / Cryptocurrency: blockchain-based ledger entries representing value.

1.3 These Terms are a public document; the current effective version is posted on the Website.

1.4 Unless otherwise specified, words importing the singular include the plural and vice versa, and words importing gender include all genders.

2. Use of the Services

2.1 Use of the Website constitutes acceptance of and agreement to be bound by these Terms and all applicable laws and regulations; you are responsible for compliance with applicable law.

2.2 We provide a simple and convenient way to exchange Cryptocurrency via the Website. You may exchange Cryptocurrency only; the Website does not permit trading between fiat currency (USD, EUR, etc.) and Digital Assets.

2.3 The Website is non-custodial: we do not store your Digital Assets as deposits or balances.

2.4 By accepting these Terms and using the Website, you represent and warrant that:

  • Age & capacity: you are at least 18 years old and have legal capacity to contract;
  • Jurisdiction: you are not located in, under the control of, nor a national or resident of prohibited jurisdictions (see Section 10);
  • Lawful funds: you transact only with legally obtained funds that rightfully belong to you;
  • Previous sanctions: you have not been suspended or removed from using the Website or services;
  • No illegal use: you will not further or facilitate unlawful activity via the Website;
  • Compliance: you will comply with these Terms and all applicable laws;
  • Personal use: you use the Website for personal, non-commercial purposes and do not act on behalf of third parties;
  • Risk acknowledgment: you understand that exchanging Cryptocurrency is risky;
  • No fiduciary relationship: LunaSwap is not your broker, intermediary, agent, advisor, or fiduciary; communications from LunaSwap do not constitute advice;
  • No deception: you will not mislead other users or third parties;
  • No harm: you will not take actions intended to damage LunaSwap or third parties;
  • No reverse-engineering: you will not reverse-engineer, decompile, or disassemble the Website or LunaSwap software;
  • Local law responsibility: you accept responsibility for complying with local laws governing your online actions;
  • Electronic communications: you consent to receive electronic communications, agreements, documents, receipts, notices and disclosures in connection with your use of the Website;
  • Service delays: you acknowledge that delays in service may occur;
  • No IP concealment: you will not use proxies, VPNs, or other software to conceal your IP address.

2.5 The Website is generally accessible 24/7. LunaSwap reserves the right, without notice or compensation, to temporarily suspend the Website or access to it for maintenance, updates, server work, or other operational needs.

2.6 To protect the integrity of the Website, LunaSwap may block Users who violate these Terms at our sole discretion.

3. AML / KYC

3.1 Users do not need to create accounts: registration or login is not required to use the Website. At LunaSwap, we share the core values of the decentralized ecosystem: privacy, transparency, and autonomy. We strive to provide users with a fast, secure, and private crypto-to-crypto exchange experience. We do not require identity verification under normal conditions. LunaSwap is designed for cryptocurrency transactions without unnecessary disclosure of personal data.

3.2 While maintaining our commitment to privacy, we have implemented an automated system for preventing risks associated with money laundering (AML). The system checks every transaction in real-time and blocks the processing of funds that have a confirmed link to illegal sources.

3.3 By accepting these Terms, you agree to undergo any AML/KYC procedures applied to you or requested by LunaSwap at any time.

3.4 During AML/KYC checks, LunaSwap may request additional information or documents, including but not limited to a scan of a government ID and information about the origin of funds.

3.5 In certain cases (e.g., to verify identity during AML/KYC), LunaSwap may freeze your exchange transaction for any period necessary to complete an investigation or the AML/KYC procedure. While an investigation is ongoing, LunaSwap may transfer frozen funds to cold storage to ensure safekeeping.

3.6 If you refuse or fail to complete AML/KYC when requested, LunaSwap may refuse to execute your current and/or future transactions.

3.7 By accepting these Terms you warrant that all personal information you provide is true, accurate, current, and complete, and you are responsible for its accuracy.

3.8 LunaSwap works with third‑party KYC providers as required. If an exchange is stopped for KYC review due to the risk-management system, LunaSwap will provide a secure link for completing verification.

3.9 The verification window is typically 3 days; you may refuse verification, in which case a refund procedure will be provided. In cases where transactions are suspected of illegal activity, LunaSwap may freeze transactions for the duration necessary to complete investigations and AML/KYC checks.

4. Personal Data

4.1 By accepting these Terms you expressly consent to LunaSwap processing your personal data and, where applicable, exporting your personal data outside your country of residence.

4.2 LunaSwap may transfer certain User data (including IP addresses) to business partners or governmental bodies where required to prevent or disclose prohibited or illegal actions. By accepting these Terms you acknowledge and agree that your personal data may be transferred in this way.

5. Prices, Exchange Rates and Confirmations

5.1 Cryptocurrency and Digital Assets are highly experimental and risky.

5.2 LunaSwap’s conversion service attempts to provide accurate price and exchange rate information, but rates are highly volatile and may change rapidly without Users’ awareness.

5.3 For normal orders, the exchange rate you receive is calculated when your payment is accepted. Acceptance typically occurs after a blockchain confirmation threshold (commonly six blocks), and a broadcasted transaction does not by itself constitute acceptance by LunaSwap.

5.4 LunaSwap’s remuneration for its services is included in the final rate applied to your exchange. You are not required to pay additional service fees to LunaSwap unless these Terms expressly state otherwise.

5.5 Contact customer support (live chat) for questions about exchange rates and prices.

5.6 Taxes: you are solely responsible for determining, reporting and remitting any taxes arising from exchanges conducted via the Website; LunaSwap does not withhold, collect, or remit taxes on your behalf.

6. Returns and Refund Policy

6.1 Cryptocurrency transactions are generally irreversible and exchange rates are volatile; all sales and exchanges performed via LunaSwap are final and non‑refundable except as set forth in these Terms.

6.2 If an error occurs, the “Order Status” page will indicate whether a refund of the deposited Digital Asset or return of the outgoing Digital Asset applies.

6.3 Deposited Digital Assets will be refunded if the Order Status indicates “failed” or if the order is stuck in “awaiting exchange”, “pending confirms” or “awaiting deposit”.

6.4 Outgoing Digital Assets will be sent if the Order Status shows “Done” or “Completed”.

6.5 Decisions by LunaSwap regarding refunds or exchanges are final.

6.6 Additional notes:

  • All outgoing transfers to your wallet are subject to posted fees, including miner/network fees.
  • Withdrawal/extraction may take up to twenty (20) business days; expedited processing may incur additional charges.
  • Unsupported assets deposited to our system may be unrecoverable; LunaSwap will handle such cases case‑by‑case and its decisions are final.
  • Transactions below the Website’s minimum limits cannot be completed.
  • Funds will only be sent to the destination address you provide; refund decisions in such cases are final.
  • Refunds, when available, can be issued only to the initial sending address or the refund address specified at exchange creation — not to a new address. To request a refund contact LunaSwap support.
  • LunaSwap accepts one (1) deposit per transaction ID (TXID). If multiple deposits share a single TXID, contact support for refund; the original exchange rate will not be honored.
  • WARNING: phishing sites impersonating LunaSwap may exist. Only use the exact LunaSwap domain and verify the site’s security certificate. LunaSwap is not responsible for funds sent to fraudulent sites or in response to unauthenticated messages claiming to be LunaSwap.

6.7 In the event of dramatic market movements, LunaSwap may be unable to execute exchanges at a fixed rate; in such cases LunaSwap will either execute at the prevailing market rate or return the deposited Cryptocurrency — at the User’s choice. “Dramatic changes” means rate movements of 3% or more in any direction.

6.8 If a User attempts to exploit temporary pricing or system vulnerabilities resulting from market changes, LunaSwap may refuse to complete the exchange and will instead return the deposited Cryptocurrency.

6.9 LunaSwap’s technical team can refund BTC sent to SegWit BTC addresses only; other assets (e.g., LTC, BSV, BCH) sent to SegWit BTC addresses generally cannot be refunded.

6.10 Token refunds sent incorrectly to an ERC‑20 address may take up to 24 hours to process.

6.11 In limited cases involving reported financial theft, LunaSwap may be able to stop or recover stolen funds. Recovery may depend on timing and the stage of the transaction; returns will be made in the asset received (the “to‑currency”). LunaSwap requires an official request from competent law‑enforcement authorities; upon receipt of required documentation in hard copy, LunaSwap may issue a refund to the initial or refund address within three (3) business days.

6.12 In limited circumstances LunaSwap may hold User funds for safekeeping for up to one (1) calendar year. After that period LunaSwap cannot guarantee preservation of unclaimed funds. Upon User request LunaSwap will make commercially reasonable efforts to return unclaimed funds after the period ends, but LunaSwap is not liable for unsuccessful recovery and Users bear any return fees.

7. Indemnification

7.1 You will defend, indemnify and hold harmless LunaSwap, its officers, directors, employees and agents from and against any third‑party claims, liabilities, damages, losses and expenses (including reasonable attorneys’ fees) arising out of or relating to: (a) your breach of these Terms; or (b) your violation of applicable laws in connection with the Website or services.

7.2 LunaSwap will provide notice of a claim and, subject to applicable law, may permit you to control the defense and settlement of such claim; LunaSwap will reasonably cooperate in such defense at your expense.

8. Disclaimers

8.1 Nothing in these Terms excludes or limits LunaSwap’s liability for losses that cannot be lawfully excluded or limited.

8.2 YOUR USE OF THE WEBSITE AND SERVICES IS AT YOUR SOLE RISK. THE WEBSITE AND SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED.

8.3 TO THE MAXIMUM EXTENT PERMITTED BY LAW, LUNASWAP DISCLAIMS ALL IMPLIED WARRANTIES, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON‑INFRINGEMENT, ACCURACY AND RELIABILITY.

8.4 LUNASWAP DOES NOT WARRANT THAT: (A) THE WEBSITE WILL MEET YOUR REQUIREMENTS; (B) ACCESS WILL BE UNINTERRUPTED, TIMELY, SECURE OR ERROR‑FREE; (C) DATA PROVIDED IS ACCURATE; OR (D) THE WEBSITE IS FREE FROM VIRUSES OR HARMFUL COMPONENTS.

9. Limitation of Liability

9.1 SUBJECT TO SECTION 8, LUNASWAP SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR EXEMPLARY DAMAGES, INCLUDING LOSS OF PROFITS, GOODWILL, DATA, OR OTHER INTANGIBLE LOSSES, EVEN IF LUNASWAP HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

9.2 SUBJECT TO SECTION 8, LUNASWAP’S AGGREGATE LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATED TO THESE TERMS OR THE USE OR INABILITY TO USE THE WEBSITE OR SERVICES IS LIMITED TO EUR 500.

9.3 The foregoing limitations apply regardless of the legal theory (contract, tort, negligence, strict liability or otherwise).

10. Prohibited Jurisdictions

10.1 You may not use the Services if you are located, registered, resident in, or subject to the laws of the following jurisdictions: Afghanistan, American Samoa, U.S. Virgin Islands, Guam, Iran, Yemen, Canada, Germany, Kingdom of the Netherlands, Cuba, Libya, Pakistan, State of Palestine, Puerto Rico, Somalia, North Korea, Northern Mariana Islands, USA, Syria, Russian Federation, Republic of Belarus, Republic of Sudan, Transnistria, Abkhazia, South Ossetia, Turkish Republic of Northern Cyprus, Western Sahara, Federal Republic of Ambazonia, Kosovo, Crimea and the temporarily occupied territories of Ukraine, in any member State of the European Union (EU) or the European Economic Area (EEA), or if you are a citizen or resident of any such jurisdiction, as well as any other jurisdictions subject to UN Security Council sanctions.

10.2 By using our Services, you confirm that you are not a citizen, resident, or otherwise not subject to the laws of the above-mentioned jurisdictions. If you fall under the category of prohibited jurisdictions specified in these Terms, immediately exit our website and cease using the Service. Violation of these Terms may lead to loss of funds, legal consequences for you, and notification to regulatory authorities. By continuing to use the service, you declare that you are not subject to these restrictions and assume full responsibility.

10.3 LunaSwap reserves the right to choose the markets and jurisdictions in which it will operate and may restrict or refuse to provide services to users located in, resident of, or otherwise associated with certain countries or territories.

10.4 LunaSwap may employ technical, contractual or other measures to prevent access to the Website and use of its services by users in prohibited jurisdictions. You must comply with this Section even if such measures are imperfect or may be bypassed.

10.5 If LunaSwap reasonably determines that funds originate from or are controlled by users in prohibited jurisdictions, LunaSwap may, at its sole discretion, seize, dispose of, or donate such funds to a charitable organization. Any such action will be taken in accordance with applicable law where feasible.

10.6 Use of the Website and services is void where prohibited by applicable law.

10.7 LunaSwap may collect or obtain your IP address and other technical data. If your IP address or other reliable indicators place you in a prohibited jurisdiction, LunaSwap may deny you access to the Website and its services.

11. Permissible Use

11.1 Use of the Website carries financial risk and is provided as an experimental software utility only.

11.2 When accessing or using the Website, you will not violate any law, contract, intellectual property or other third‑party right, and you are solely responsible for your conduct while using the Website and LunaSwap services.

11.3 Without limiting the foregoing, you will not:

  • damage, disable, overburden or impair the functioning of the Website in any manner;
  • use the Website or services to pay for, support, or otherwise engage in illegal activities (including illegal gambling, fraud, money‑laundering, or terrorist activities);
  • use any robot, spider, crawler, scraper, or other automated means or interface not provided by us to access the Website or extract data;
  • distribute viruses, worms, Trojan horses, corrupted files, hoaxes, or any other items of a destructive or deceptive nature.

12. Termination

12.1 These Terms take effect when you begin using the Website and remain in force indefinitely unless terminated as set out herein.

12.2 LunaSwap may suspend your access to the Website for any reason, including breach of these Terms, immediately, without prior notice and without liability.

13.2 LunaSwap may add or remove features, modify functionality, or impose new limits on use of the Website at any time.

14. Links to Third‑Party Sites

14.1 The Website may contain links to third‑party sites and content. LunaSwap does not monitor or endorse such sites or their content and is not responsible for them.

14.2 When you follow a link to a third‑party site, your relationship with LunaSwap with respect to that content terminates; LunaSwap is not responsible for the accuracy, legality, or quality of services or content on third‑party sites.

15. Copyright Protection

15.1 Use of the Website does not grant you ownership of any intellectual property rights in the Website, its software, or its content.

15.2 Materials on the Website are protected by applicable copyright and trademark laws and treaties.

15.3 Use of search queries comprising LunaSwap’s domain or brand name (including variations and misspellings) in paid search advertising to attract affiliates is prohibited; violation may result in exclusion from affiliate programs (including blocking API keys and withholding profit withdrawals).

16. Modifications to These Terms

16.1 LunaSwap may revise these Terms at any time and without prior notice; some changes may be made retroactively where permitted by law.

16.2 By continuing to use the Website after changes are posted you accept the then‑current Terms. You should regularly review these Terms for updates.

17. Assignment

17.1 LunaSwap may assign or transfer its rights and obligations under these Terms to third parties without your consent.

17.2 You may assign your rights or obligations under these Terms only with LunaSwap’s prior written consent.

18. Entire Agreement

These Terms constitute the entire agreement between you and LunaSwap and supersede any prior arrangements relating to the subject matter of these Terms.

19. Severance and Validity

19.1 If any provision of these Terms is held illegal, invalid or unenforceable in any jurisdiction, that provision shall be severed and replaced with a lawful provision that most closely matches the intent of the severed provision.

19.2 The remaining provisions shall remain in full force and effect.

20. Costs

20.1 Where LunaSwap incurs reasonable administrative costs addressing issues caused by a User (and not resulting from LunaSwap’s negligence), LunaSwap reserves the right to recover such costs from the User.

20.2 Except as otherwise provided in these Terms, each Party bears its own costs and expenses in connection with negotiation, preparation and performance of these Terms.
